Early Success in Texas: Collaborating with TX Community Pharmacists & Physicians to Protect Independent Pharmacists, Specialty Community Physicians, and Patients

AmerisourceBergen’s (AB) Elevate Provider Network (Elevate), Specialty Physician Services (SPS) and Good Neighbor Pharmacy (GNP) segments are partnering with American Pharmacies (AP), independent community pharmacists, and community physician practices to advocate for three legislative measures that will improve patient care. Specifically, HB 1763, HB 1919, and HB 2787 aim to prohibit PBM tactics that directly impact providers and their patients by:

  • Curtailing retroactive recoupment practices;
  • Prohibiting PBM steering practices that limit patient choice;
  • Increasing transparency into relationships between insurers, PBMs, and their affiliated pharmacies;
  • Protecting patient choice to be able to use their preferred pharmacy; and
  • Helping to ensure that the state can more effectively regulate PBMs within the context of ERISA covered health plans.

Working in tandem with AP, the AB Government Affairs and Public Policy team (GA&P) recently shared calls to action asking Texas-based GNP pharmacists and specialty physician customers to call their state representatives and urge support for these bills. In addition, GNP, Elevate, and SPS sent letters to Texas Speaker Dade Phelan (R-21) and members of the Texas House of Representatives, asking that they vote “YES” on all three bills when called for a vote on the House floor.

This collaboration and partnership with AP and Texas providers is yielding positive results as the Texas House of Representatives voted to pass all three bills near the end of April. There is, however, more work to be done and the GA&P team will continue to coordinate with our internal business leaders, industry stakeholders, and Texas-based community providers to ensure that all three bills receive continued support in the Senate, with an end goal of enactment into law.

We thank everyone who took time out of their busy schedules to educate state legislators in TX by contacting them to ask for their support on these important measures, and we encourage Texans to continue to contact their state legislators in TX to urge enactment of these bills this year.
